Please read these Terms of Service ("Terms") carefully before using the ActionCut-AI desktop application (the "Software"), developed by GenAIDev4All ("we", "us", or "our").

By purchasing, downloading, or using the Software, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, limited license to install and use ActionCut-AI on compatible Windows personal computers owned or controlled by you.

2. Software Operation

The Software is provided as a local desktop tool. You are solely responsible for ensuring your hardware meets the system requirements necessary to run the Software. Because all processing is local, you retain full ownership and responsibility for all content and video files created or edited using the Software.

3. Orders and Payments

Payments for the Software are managed and processed by Creem.io, our authorized Merchant of Record. By completing a purchase, you agree to Creem.io's terms and conditions in addition to these Terms.

4. Refund Policy

Refund requests are handled in accordance with Creem.io's standard refund policies and applicable consumer protection laws. If you encounter technical issues or are unsatisfied with your purchase, please contact us at [email protected].

5. Intellectual Property

The Software, including its code, design, logos, and interface, is owned by GenAIDev4All and protected by copyright and intellectual property laws. You may not reverse engineer, decompile, disassemble, modify, or redistribute the Software without our explicit written consent.

6. Disclaimer of Warranties

The Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We do not warrant that the Software will be error-free or uninterrupted, or that it will meet your specific requirements.

7. Limitation of Liability

To the maximum extent permitted by law, GenAIDev4All shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or hardware damage, arising out of or related to your use of the Software.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
